General contract conditions
1. PARTIES AND ACCEPTANCE OF THE GENERAL CONTRACT CONDITIONS:
(hereinafter also the General Conditions or CGC):
On the one hand, the provider of accommodation reservation management at MASIA MAS JULI, S.L. (hereinafter also the provider and MAS JULI), with registered office at C/Ramon Casas, no. 2, 08397, Pineda de Mar, Barcelona, N.I.F. B67984328, customer service telephone number +34 639 77 92 92, and e-mail: info@masjuli.com, being the owner of the website www.masjuli.com, exposes the contractual document that will govern the contracting of room reservations of the Masia through the reviewed website.
And on the other hand, the User – Client (hereinafter the User), who makes the reservation and is responsible for the veracity of the personal data provided to the provider.
BOTH ACCEPT this document, and it implies that the user:
- You've read, you understand and you're agree with this text.
- Who is a person of legal age and with sufficient capacity to contract.
- That assumes all the obligations set forth herein.
- That you have read and accept these general purchasing conditions from the moment you make any reservation.
- This document can be printed and stored by Users.
The provider makes the email address info@masjuli.com available to them so they can raise any questions about these conditions.
These conditions will have an indefinite period of validity and will be applicable to all contracts made through the provider's website www.masjuli.com
The provider reserves the right to unilaterally modify these General Conditions, without this affecting the reservations or promotions that were acquired prior to the modification, in order to improve the services offered. In any case, these general conditions must be consulted before booking.
It is advisable that you keep a copy of the data contained when making the reservation. MAS JULI is not responsible for any loss of data, files or any damage resulting from a failure of backup by the User of the data contained in the reservation made.
The civil liability of MAS JULI for the services provided is limited to the amount thereof, the user waives any claim to MAS JULI. for any reason in any case of dissatisfaction with the services acquired on the website www.masjuli.com, as well as possible failures, slow access or errors in accessing the website, including loss of data or other types of information that may exist on the computer or network of the user who accesses the website www.masjuli.com.
MAS JULI makes room reservations available at La Masía to attend yoga retreats through its website.
2. OBJECT OF THE CONTRACT
2.1 Scope of application: The purpose of this contract is to regulate the contractual relationship of accommodation reservation. This entails the reservation of the chosen room, for a limited time, in exchange for a certain price publicly displayed through the website. The user accepts these booking conditions during the online contracting process by checking the corresponding box. These GTC will apply from the day the reservation is made.
2.2 Territory of application: The reservation possibility of www.masjuli.com is active for everyone.
2.3 Capacity to contract: In order to make a reservation you must be of legal age and have the capacity to contract.
2.4 Customer acceptance: Validation of a reservation through the website www.masjuli.com is done by email and also implies automatic acceptance of the GTC. These conditions are available on the website www.masjuli.com or, if you wish and request, we will send them to you by email.
2.5. Modification of the General Contracting Conditions: MAS JULI reserves the right to make changes and/or modifications to these GTC. We advise our clients to review them regularly. In the event that these changes or modifications are introduced once a reservation has been made, the conditions in force on the date on which said reservation was made will apply.
3. INFORMATION PROVIDED ON THE WEBSITE www.masjuli.com:
3.1 Publication of prices: The prices of the rooms are those shown in the information for each of them on our website www.masjuli.com.
3.2 Room information: The information contained in our advertising, brochures, other written material, on our website or that provided to the user constitutes an invitation to make a reservation. The contents of www.masjuli.com are constantly renewed and updated to offer our clients the most complete and detailed information possible. All contractual information present on www.masjuli.com is displayed in Spanish (Castilian) and communication with clients and users, as well as the formalization of the contract, is carried out in this language. If the client requests it before starting the relationship, it can be done in Catalan.
3.3 Availability of room(s): The published retreat rooms may be available or already reserved. Next to each room, your availability and reservation option will appear.
3.4 Reservations 24 hours a day, every day of the year: La Masia is open to the public all year round. The reception schedule for room reservations for yoga retreats via the web is twenty-four (24) hours, 365 days. Once the reservation is made, you will automatically receive an email confirming the process and another confirming the purchase when the provider has received and confirmed the payment of the advance payment corresponding to the amount of the reservation.
3.5 Fraud: If MAS JULI suspects or detects any anomaly or fraud, it reserves the right to cancel the transaction for security reasons.
4. RESERVATION PROCEDURE
In order to access the services offered by the provider, the user must not register through the website by creating a user account. You will only be asked for the essential information to be able to process your reservation.
Once you have selected the room you wish to reserve, you are informed that in accordance with the requirements of art. 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow the following steps:
Choose the desired rental by clicking on it, and it will be added to the shopping cart by clicking on the “add to cart” button.
Once the reservation has been chosen, you must click on “complete purchase”. By clicking on this option, the purchase confirmation will appear.
A series of personal data will be requested to make the reservation, and then the user's consent is requested to save their data. If you provide it, information about our services and/or offers will be saved and sent to you if you allow it, otherwise the data will be saved for future purchases only.
You should check your email inbox for spam and junk mail controls and always verify that the contact details you provide are correct.
Once your data has been filled in, the total amount of the reservation and the amount referring to the advance payment will appear, along with a check box that you must mark since it is the acceptance of these General Contracting Clauses and the Privacy Policy.
To finish the process, you must click on the “place the order” button.
In any case, the provider's contracting platform will inform the user, once the contracting procedure is completed, via email regarding all the characteristics, price, contracting date and reservation dates.
If there is any type of error in the address indicated or in any other point of the reservation, you must notify it immediately to the email address indicated above to proceed to correct this error.

5. RESERVATION CONFIRMATION
The PROVIDER will reserve the room under the payment conditions.
At the time of completion of the online reservation, we will send you the payment conditions and reservation details to the email address you provided when making the reservation.
If there is any error in the data, you must immediately contact our Customer Service line +34 639 77 92 92 or send an email to info@masjuli.com, so that we can proceed with the appropriate rectification.
6. PRICES AND DEADLINES FOR THE VALIDITY OF OFFERS:
All prices displayed on the website www.masjuli.com include the VAT in force at the time of booking. All prices listed on the website are valid and will be expressed in Euro (€) currency. These expenses, unless expressly indicated otherwise, do not include cancellation expenses, nor do they include tourist taxes and/or travel insurance.
The user will receive the reservation invoice to the email address provided by the user once the reservation is made.
The prices applicable to each accommodation room will be those published on the website and applied automatically by the contracting process in the last phase of the contract.
In cases of promotions of limited duration, the promotion discount will be applied as long as the reservation has been registered during the promotion period.
The data recorded by the different payment methods constitute proof of the date on which the financial transactions were made and will be used to determine whether or not said reservation is subject to promotion.
For any information about the reservation, the User may contact the provider's customer service telephone number or via email to the address provided.
7. PAYMENT FORMS
The payment system available for booking online yoga retreats is payment by credit or debit card: The user must have a valid credit or debit card, where they must specify all the digits of the card number in the form correspondent. The operation is formalized at the time of placing the order. Payments are only accepted with secure cards in which your identity as the cardholder is authenticated according to the method established by your bank, through secure electronic commerce ("Verified by Visa" and "MasterCard SecureCode"). The order cannot be taken into account and will not be processed until the payment has been authorized by your bank or savings bank.
The system called SSL (Secure Sockets Layer) is used, a payment system in a secure environment since it allows the encryption of the information transmitted during the transaction, ensuring its confidentiality.
8. CANCELLATION AND PAYMENT CONDITIONS
The right of withdrawal will not apply to contracts that refer to the supply of accommodation services for purposes other than housing if the contracts provide for a specific performance date or period.
The cancellation of the reservation can occur in the following ways:
- Cancellations due to force majeure or COVID-19 restrictions: 100% of the booking will be refunded.
- Bookings cancelled 60 days or more in advance: 100% of the pre-payment will be refunded.
- Reservations canceled less than 60 days in advance: The advanced amount will not be refunded.
Cancellations must be requested in writing by email to info@masjuli.com. The money will be returned within 14 days of processing the cancellation using the same payment method.
If the reserved accommodation is not occupied on the day of arrival or at the latest on the following day before 12 noon, the reservation will be automatically cancelled, unless we have been notified in writing of the delay.
In case of delay on the day of arrival or early departure, 100% will be charged, unless an agreement is reached between both parties.
Users who have made the reservation via the web will pay an advance payment. When you arrive at the Masia you will pay the remaining amount.
9. CONDITIONS OF THE STAY
Arrivals: The accommodation can be occupied on the day of arrival from 4pm.
Upon arrival and in accordance with current legislation, the USER must submit the reservation sheet and all occupants of the accommodation will be identified.
Departures: you must leave the scheduled departure day before 12 noon in the morning.
USER Responsibilities:
The USER undertakes to respect the regulations of the Masia. During rest hours from 10:00 p.m. to 8:00 a.m., it is not allowed to use the rooms for party celebrations or make noise. In no case is it allowed to occupy the room by more people than those established in its maximum capacity.
The USER is responsible for the correct behavior of all his/her booking companions; otherwise, the PROVIDER reserves the right to expel the occupants of the accommodation, without the right to future claims or any type of compensation.
MAS JULI will not be responsible for any direct or indirect damage that may be caused as a result of misuse of the room, including without limitation: destruction, loss after fire, theft, crime, accidents or other types of damage.
Animals are not accepted at MAS JULI.
The provider will not be responsible for reservation errors attributable to the user or caused by unavoidable and extraordinary circumstances.
10. NULLITY AND INEFFECTIVENESS OF THE CLAUSES
If any clause included in these General Conditions is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will affect only said provision or the part thereof that is null or ineffective, the General Conditions subsisting in everything else, such provision, or the part thereof that is affected, being considered not in place.
11. ONLINE DISPUTE RESOLUTION
In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for the resolution of online conflicts between the USER and the PROVIDER, without the need to resort to the courts of law, through the intervention of a third party, called the Dispute Resolution Body, which acts as an intermediary between the two. This body is neutral and will dialogue with both parties to reach an agreement, and may finally suggest and/or impose a solution to the conflict. 12. APPLICABLE LAW AND JURISDICTION
These conditions will be governed or interpreted in accordance with Spanish legislation in that which is not expressly established. The provider and the user agree to submit any controversy that may arise from the provision of the service that is the subject of these Conditions, to the Courts and Tribunals of the domicile of the provider (if he is not considered a consumer for the purposes of the TRLGDCU) or of the user (if he is considered as a consumer for the purposes of the TRLGDCU).
13. APPLICABLE REGULATIONS
These General Conditions are subject to the provisions of:
European regulations that regulate electronic commerce:
- Directive 97/7/EC on the protection of consumers in relation to distance contracts (Distance Sales Directive);
- Directive 2000/31/EC on certain legal aspects of information society services, in particular electronic commerce in the internal market (Electronic Commerce Directive).
Spanish regulations:
- Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users.
- Law 7/1998, of April 13, on General Contracting Conditions, and subsequent modifications,
- REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and the free circulation of these data and repealing the Directive 95/46/EC (General Data Protection Regulation)
- Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights,
- Law 7/1996, of January 15, on the Regulation of Retail Trade,
- Law 34/2002 of July 11, on Information Society Services and Electronic Commerce and subsequent modifications.
- DECREE 75/2020, of August 4, on tourism in Catalonia.
